Let Tenants Live This page is created to bring together people to save every Mumbiakar from the disastrous effects of the proposed amendment to the Maharashtra Rent Act ft.

The Maharashtra government has recently proposed to amend the Maharashtra Rent Control Act (1999) to remove rent protection on residential premises in excess of 862 sq. and business premises in excess of 542 sq.ft. thereby requiring lower and middle class residents and businesses to pay market rent as high as 200 times the current rent. This amendment has the potential to displace 5 lakh families,

have over 30 lakh people to leave the houses that they have lived in for generations. Those who work in small and medium size businesses, the number of which can be well in excess of 40 lakhs, could well lose their livelihood in the form of jobs or small businesses or as professionals. Those who are not directly affected will face a many fold increase in the cost of goods and services that they avail of in the island city, as businesses and service providers would have to recover the cost of astronomical rents or highly inflated real estate prices. Assuming that those who cannot afford the astronomical rents will move to the distant suburbs, the already stretched and failing public transport and infrastructure will break down due to the additional load of this migrating population. All this simply to benefit a few in the form of the powerful builder lobby which is already holding this city to ransom with artificially inflated real estate prices. This single piece of proposed legislation will destroy the city of Mumbai as we know it and will directly or indirectly inflict untold rise in prices and hardships on every Mumbaikar. This page has been setup to create awareness of the full implications of this misadventure and bring together every citizen of Maharashtra to stand up and save the city which generations have worked for and left to us as a legacy. Are we to tell our current and future generations that this sweet melting pot we call Mumbai has no place for them anymore? Request each one of you to like this page and keep updated and support the effort to fight this proposed legislation to a favourable conclusion. We would use this page to keep you abreast of developments and provide a forum to express your opinion. Let’s all come together.

Friends ,

I attended both the MLA meeting.
On behalf of "Action committee for the protection of tenants' rights".

Few observations:

1) Shri Raj Purohit meeting at Garware at 9 am was packed before 9 am only.
Wonderful response.
Prabhuji explained the issue in a well defined manner.
Raj purohit is very much awaken.
He knows it's a huge 'Vote Bank' he can't afford to loose.

2) Even Shri M P Lodha meeting was packed at Sharda school.

3) Mr Lodha we must appreciate his one statement that 'If such Act/ Rule comes he will resign from his MLA post'

This is a very big statement in favor of Tenants.

4) Both MLA spoke well and both passed resolution to pressure Govt to 'convert Tenants into Ownership'.

5) Raj purohit And Shaina N C. Both quite confident that this was only 'Rumor and Press news' 'No official comments from Govt'
But Lodha Ji candidly said that 'Proposal being discussed'

So there is a contradiction in understanding this 'Move'.

However My view:

1) Only one platform 'Action committee for the protection of tenants' rights'

We all should support this platform only being a 'Non Political One'.

No other platform to be formed as there was some ideas being floated by someone at Garware.

Be careful.

2) Our move should be to discuss 'how to make tenants in to ownership' only.

3) We must give ultimatum to Govt .

4) All donation / contribution should be to 'Action committee for the protection of tenants' rights'

5) Do not get carried away to any politician statement and also do not make platform of any MLA/ MP.

6 )Must attend any meeting called by MLA/ MP in any areas.

7) Make area wise and building wise what's app group.

The Government plans to amend the Rent Control Act to increase Rent of residential and commercial premises in Mumbai by over 200 times thus making housing un-affordable!! This will further give the landlords vast powers to evict tenants. This will adversely affect several lakhs of people in Mumbai…

A Landlord’s Perspective
In relation to proposing the case for landlords, statistics show that a majority of the tenanted premises are no longer held by original tenants of the buildings which related to the 1940’s and 50’s. Thus, these are premises effectively transferred by landlords on the Pagdi system.

For those who propose that the rates should be decided by market forces, be informed that the entire system has evolved by market forces. Why else would landlords transfer the premises to new tenants after vacation of the earlier tenant? The reason being that not only do they retain ownership of the premises but also partake of the appreciation of the property every time the property is transferred-which till late was “appreciation sans taxation”.

On vacation, landlords have the option to sell the premises on ownership or give the same out on leave and license basis at market rents. The very fact that they do not, is adequate proof of their favouring this system. Selling the premises on ownership would involve a one time appreciation, directly taxable, and market rents rarely are more than 1% or 2 % return on the value of the premises. You do the math. Landlords already have.

As proof that this was a valid market driven transaction and seeing the loss of revenue, the government also established that extinguishment or transfer or surrender of tenancy / lease right is subject to Income Tax under the head Capital Gains. Further, various courts too have consistently taken the view that surrender of tenancy right is a capital asset.

Thus, if this is a valid asset which has been taxed in the past, the current amendment would be liable in destroying capital asset value of these tenants at one shot.

Last I checked destroying capital assets intentionally was a criminal offence….
