As a business owner of a trucking company, staying compliant with various tax and regulatory requirements is crucial to keeping your operations running smoothly. One important and new aspect of compliance is filing the Beneficial Ownership Information Report (BOIR).

What is BOIR?

Starting January 1, 2024, the Corporate Transparency Act (CTA) mandates that many small businesses, including those in the trucking industry, must file BOI reports with the Financial Crimes Enforcement Network (FinCEN). This new requirement aims to increase transparency and combat financial crimes by collecting information about the individuals who own and control these businesses.

Who Needs to File BOIR?

If your trucking business is registered as a corporation, limited liability company (LLC), or similar entity and meets the criteria for significant control or ownership, you may need to file the BOIR. The specific requirements can vary, so reviewing the latest guidelines from the U.S. Department of the Treasury’s Financial Crimes Enforcement Network (FinCEN) is essential.

Required Information
The following information is required to successfully lodge your BOIR:

Full legal name of applicant(s) & beneficial owner(s)

Date of birth of applicant(s) & beneficial owner(s)

Current business address & residential address of beneficial owner(s)

Copy of government issued ID (e.g., passport or driver’s license number)

SSN/EIN/ITIN of beneficial owner(s)

Driving during the winter can get pretty rough, especially for those of us from the south who may not be used to some of the crazy snow our trucking friends in the north see. Regardless of where you’re from, here are a few pointers to help conquer the snow and chilly weather this winter.

Inspect Your Vehicle
Before anything, always do a full inspection of your truck and trailer and confirm it’s capable of making the trip. When facing cold weather, it’s always a good idea to check the brakes and tires, tire pressure, engine oil and antifreeze levels before packing up for a long road trip. Remember in colder weather, tire pressure can go down, so keep an eye on that periodically as well!

Watch Your Speed
During the winter, temperatures tend to fall to below freezing regularly in some places. Research by the AAA Foundation for Traffic Safety has shown winter storms and bad driving conditions are a factor in nearly half a million crashes and more than 2,000 deaths every winter. Slowing down a few mph could be the difference in avoiding a wreck and possibly something worse!

Visibility
When inspecting your vehicle before your trip, it’s a good idea to check your lights and remove any debris or ice from your windshield. Along your trip, if your windshield starts to build up with more snow or ice, you should take some time to pull over and remove it. If conditions worsen, waiting out the bad weather may prove to ultimately make your drive easier in the long run.

Plan Ahead
Before your trip, look ahead at the roads and areas you’ll be going through. In other words, check the weather on your laptop or download a weather app on to your phone. This way, you’ll know what you could possibly encounter along the way. Not only should you look ahead at your route, it’s always a good idea to pack enough warm clothes and other supplies (ice scraper, sandbags, traffic cones, etc.) that may come in handy should you encounter other problems.

Each year on the third Monday of January we observe Martin Luther King Jr. Day and reflect on the work that still needs to be done for racial equality. This January 16, make the holiday more than just a day off and take time to reflect and take action on civil rights issues across the globe.
Dr. King was born on January 15, 1929, in Atlanta, Georgia. From a young age he was heavily influenced by his father — a pastor and community organizer — and eventually began his own career of service in Montgomery, Alabama as a community leader in the NAACP. In 1955, Dr. King helped lead the Montgomery bus boycott after Rosa Parks was arrested for refusing to give up her bus seat and violated local Jim Crow laws in Alabama. These peaceful protests — which are widely considered the first mass demonstration against segregation — lasted for 385 days and gained national attention.
He continued to spearhead some of America’s most groundbreaking social justice demonstrations. In 1963, more than 200,000 demonstrators marched towards the Lincoln Memorial in Washington D.C. to protest economic and racial inequality. This March on Washington is one of the most famous acts of the Civil Rights Movement, and it is where Dr. King delivered his exalted “I Have a Dream” speech. It remains one of the largest rallies for human rights in the U.S. and is credited for helping to pass the Civil Rights Act of 1964. He also participated in the Selma to Montgomery Marches in 1965 to advocate for equal voting rights. That same year, the Voting Rights Act was passed.
Dr. King was later awarded the Nobel Peace Prize, and posthumously awarded the Presidential Medal of Freedom and the Congressional Gold Medal. In honor of his birthday, MLK Day is celebrated on the third week of January every year. It was signed into law in 1983 and has been celebrated by all 50 states since 2000.
Today and everyday, Dr. King’s dream lives on in the hearts of millions of Americans who are taking action and giving back to their communities. Happy Dr. Martin Luther King Jr. Day!

A fuel surcharge is a separate, additional fee added above the current contract rate when the cost of fuel exceeds a defined level.

Key terms to understand:

Average Miles Per Gallon (mpg) – The average fuel consumption for a loaded big rig today is about 6 mpg.
Fuel Price Baseline – This is the fuel cost amount you used in figuring your cost of operation.
Average Diesel Fuel Price – The U.S. Energy Information Administration (EIA) posts the average diesel price every Monday.

The calculation is simply, this take the current fuel price, which as of 3/14/22 was $5.25 per gallon,
minus the fuel price baseline ($2.50) taken from the carrier’s cost of operation figures, which equals a difference of $2.75 per gallon.
The second calculation is to divide the difference by the average mpg – or $2.75 ÷ 6.0 mpg = $0.46 per mile.
Or, one could simply add a 0.01 cent per mile (cpm) surcharge for every 0.06 cent rise in the pump price of fuel as mentioned earlier.

Key take aways:

A fuel surcharge isn’t meant to cover the complete cost of fuel.
You cannot get around knowing your cost of operation, meaning you need to know how much to charge in order to make a profit.

Most OO’s running under their own authority operate in the spot market, meaning they go through brokers to obtain freight rather than having a contract with a direct shipper.

Brokers don’t typically pay a fuel surcharge, so you will want to incorporate your fuel surcharge in your all-inclusive rate negotiations.

You can go to OOIDA Fuel Surcharge Calculator and check your Fuel Surcharge figure and start incluiding it on your rate negotiations.

What is IFTA?

IFTA or the International Fuel Tax Agreement is an agreement between different US states and Canadian provinces. This agreement simplifies the process of redistribution of fuel taxes that intrastate carriers pay in different states.

Before the IFTA fuel tax agreement, interstate drivers were required to acquire fuel permits from every state that they drove in. Now, carriers only need to report jurisdictional fuel use to their base state, which then collects taxes on net fuel use and reimburses other states.

Who qualifies for IFTA report?

1.- Vehicles with 2 axles and gross vehicle weight or registered vehicle weight exceeding 26,000Lbs.

2.- Vehicles with 3 or more axless regardless of its weight.

3. Vehicles, used in combination, when the weight of that combination exceeds 26,000Lbs.

Remember to file your 2nd quarter IFTA report due to July 31st.

#3 RETAIN TRACTION WHEN DESCENDING/ASCENDING A STEEP GRADE
If you are losing traction when descending or ascending a steep grade, you can regain control by following these steps.
1 ) Be careful not to overheat the engine. Turn on the engine fan.
Do NOT push the truck up the hill. Let it walk up the hill. If you push the truck too hard, it can easily overheat. Keep your eye on the temperature gauge.
2) If the grade is slippery, throw in the diffs before you start the climb. Using all the drive wheels will aid in pulling you up the hill.
3) If the hill is slippery, do not follow in the tracks of the vehicle ahead of you.
Make your own set of tracks. Pull a little bit to the right. Run one set of your drives on the shoulder of the road, in hope of getting the benefit of the gravel from the road shoulder for nice, extra traction.
4) Don’t give the truck too much fuel. I like to feather the fuel. This way, the truck is less likely to spin its wheels. Gradually give the truck power.
5) Keep the engine close to the top of the RPM range.
#4 WATCH THE WEATHER AND CHAIN UP (IF NEEDED)
Another invaluable safety tip for truck drivers running mountain routes is to pay attention to weather reports.

This will help with trip planning. Mountain weather is unpredictable so it is good to check the weather the day of your route. If there’s an alternate route without a steep grade, you could always reroute yourself and take the other route just to be on the safe side.

In some cases, this may even be faster depending on if you’re facing heavy snow or ice conditions. Be prepared for the changes in weather when climbing or descending a grade.
If the chain signs are posted, respect the signs. Chain at the bottom of the hill. Do not wait until the truck spins out and the truck slides backwards down the hill.
If the hill is icy, I would recommend not attempting to climb or descend the hill.
Stay put until the sanders are out and the chain up signs are down.
