On Tuesday the 4th June 2013, Mr Entsch (Leichhardt—Chief Opposition Whip) gave a speech to the House of Representatives about the way in which CASA has acted towards Barrier Aviation. His speech as follows:

Mr ENTSCH (Leichhardt—Chief Opposition Whip) - I rise tonight to outline a very serious issue—the seemingly corrupt and anticommercial conduct of the Civil Aviation Safety Authority office in Cairns, which appears to hide in the shadows and cites 'safety' as a reason to advance personal vendettas against local aviation operators. Numerous operators in Cairns have been subjected to incompetence, threats and demands from individuals who make decisions outside of CASA's authority. Barrier Aviation is the most recent victim, but I know of at least three other operators who have been irreparably damaged by the gestapo tactics of a few individuals, namely, Phil Lister, Mark Ayrey and Gerard Campbell, and with the Director of CASA himself turning a blind eye.

The complaints include: totally incorrect interpretations of regulations, requiring operators to jump through unnecessary hoops at the inspectors' commands; the inexperience of inspectors, not knowing how to interpret regulations or legislation; inspectors entering aircraft unauthorised and unsupervised and interfering with master control switches; inspectors threatening regulatory action if operators do not do as they are told even when the inspectors are wrong; formal complaints being buried and never responded to.

It is common knowledge within the aviation industry that, if CASA want you shut down, they simply bury you with regulations and wear you down with costs until you go broke. In Cairns the personal vendetta against David Kilin, an industry stalwart of almost 40 years, has led to the closure of his life's work. It started back in 2011 when a complaint was made by Barrier to the Industry Complaints Commissioner. This complaint implicated a number of individuals within CASA Cairns who had displayed incompetent, unethical and irresponsible conduct towards Barrier. In a blatant conflict of interest, the main subject of the complaint, Mr Phil Lister, remained as an inspector of Barrier Aviation and associated companies and, incredibly, received a promotion. Despite requests, CASA's office refused to assign Barrier to another CASA office. Meanwhile, the complaint was never responded to and, in retaliation, CASA spent almost 18 months setting Barrier Aviation up. This included a complaint that was lodged against Barrier by a disgruntled ex-employee, who then fled back to his home country of New Zealand, resulting in the cancellation of Barrier's AOC.

Barrier has serious concerns with CASA Cairns's procedures, including the total lack of collaboration between CASA and the industry, unilateral decision-making, reversal of the onus of proof and the lack of procedural fairness and rights of appeal. At no time did CASA try to work with the operator to address their concerns. It was simply a witch-hunt to seek revenge on David Kilin. CASA has lied about evidence and padded their investigation to make Barrier into an unsafe operator despite Barrier previously excelling in this area.

What is also unbelievable is the abuse of process. Six months after Barrier was forced to shut its doors, they still have not been able to test a single allegation in court—and at the cost of $28,000 per day in lost revenue. And to top it off, CASA has sent press release after press release with statements that have never been tested.

Around 50 people have lost their jobs, investors have lost millions of dollars, and David Kilin has lost his life's work. And even now, CASA is not content with just burying Barrier, they want to dance on the grave as well. I was disgusted to learn that CASA Cairns has been speaking to potential purchasers of Barrier aircraft, threatening that they will not approve their airworthiness.

Since Barrier's very public demise, I have had numerous calls from right across the country from people telling me that CASA Cairns has a history of destroying small businesses. The most troubling thing is that, while these callers are keen to express a huge amount of sympathy for Barrier, they are too scared to speak publicly. This industry urgently needs an independent body and rights mechanisms to hold CASA Cairns accountable for their own inadequacies and conduct. After 14 September, I will be calling for a full inquiry. I will not let Barrier be destroyed without holding those individuals who are directly responsible for this sordid business accountable for their actions.

OPEN STATEMENT FROM BARRIER AVIATION DAVID KILIN

“Clearly we are very disappointed by CASA’s latest action. We still have a right of appeal and several alternative steps that we can take. At this stage we are exploring our opportunities with our legal team.

I would like to make it very clear that at no stage has CASA entered into any meaningful or productive discussion about how to resolve any perceived issues. We have continually asked what do they want us to do, but that has not been forthcoming at any stage.

In my opinion (and the opinion of many others), CASA’s draconian approach has been a personal vendetta against me, hidden behind their catch cry ‘it is all about safety’. Their PR machine has been both cunning and manipulative, whilst we have been shackled and made to tow the line every step of the way.

It is ludicrous to think that Barrier Aviation would want anything but safe planes and practises for our staff and our passengers. A clean, twenty year reputation and business is destroyed because of bureaucrats playing out their own agendas yet again. Every year we have tens of thousands of flights conducted without a single passenger harmed in any way.

We are not the first small regional airline to be treated this way. QANTAS and VIRGIN are too big to be bullied by CASA – we are not.

At this stage the future of Barrier is uncertain. We will take stock in the coming days and plan a media conference for early next week to provide an update.”

To Our Valued Customers,

We want to give you a brief update regarding the grounding of Barrier Aviation. As you know it is has been well over two months and we are still going through the process with CASA.

Our biggest concern is that CASA are not obligated to speed this process up, but we of course do want to resolve this as soon as possible. We at Barrier Aviation haven’t asked for any special treatment, just a timely resolution to the issues at hand. We have fully co-operated every step of the way and continue to do so, but it is reaching a point where our business will not be able to recover from this unreasonable and lengthy grounding.

We think that the issues CASA has raised could have been dealt with professionally and without the ambush on Christmas Eve. We were ready then and still are ready now to deal with CASA on a co-operative and professional basis; there should have been no reason to be grounded. Regrettably we have been forced to place our customers in such an inconvenient situation.

We also appreciate all the support our wonderful staff have given us at this difficult time. They are all aware of what is going on and are still standing by us at this time.

Judge Orders Mediation

In a Federal Court hearing held in Sydney today the Judge has ordered that CASA and Barrier Aviation move to mediation early next week in a step to resolve a number of alleged issues. A second hearing will take place on Friday, 22nd of February in Sydney.

Mr David Kilin, Managing Director of Barrier Aviation explained “we feel that mediation is a major step in the right direction and it is certainly something we have been pushing for since being grounded in December."

The fact that mediation and the follow up Court hearing will take place within seven days is an indication that both parties want to resolve any alleged issues quickly. We applaud this response as the financial strain of being grounded for so long is certainly proving challenging.

That said, we have to look forward. We continue to stand by our 20 year history and safety record and we welcome the opportunity to defend our name and reputation. We remain extremely grateful for the overwhelming support we continue to receive from throughout Cairns, Cape York, Torres Strait and Darwin.

As you may be aware in late December Barrier Aviation had its AOC (Air Operators Certificate) suspended whilst CASA reviewed some aspects of the company’s Horn Island operation.

Of course we will be defending this action vigorously, but at the same time I wanted to write to you as the Managing Director of Barrier Aviation to keep you abreast of the situation.

We have been operating in this region for over 20 years. We have been working with many of our clients throughout Far North Queensland and the Northern Territory for much of this time. Judging by the emails, letters and calls of support, we have always provided a quality service valued by a large number of people. This support has been very humbling for us.

Many individuals and organisations count on us to fly them around these regions, where we provide vital links (and often the only link) for residents and businesses alike.

We were extremely surprised by the action taken by CASA, especially as our AOC (Air Operators Certificate) had just been renewed in late November. Regardless of that, we have to go through the process and of course do everything we can to get back in the air as quickly as possible.

I would like to state emphatically that we have always been and will always be absolutely committed to the safety of our passengers and our crew. That was our commitment 20 years ago when we started the business and we never, ever deviate from this commitment.

This is certainly a challenging time for an airline, but rest assured we will be back in the air shortly. Unfortunately I can’t give any specific time frame as that is now in the hands of CASA and the process that they follow.

That said, we are hoping that CASA will work through the current situation as efficiently and as quickly as possible so that we can get back in the air, servicing our valued clients, in the very near future.
