Under FOB (Free on Board) Origin—often used interchangeably with "FOB Shipping Point"—the seller is responsible for delivering and loading goods onto the vessel at the named port of origin. Once the goods are safely on board, all risks, costs, and responsibilities transfer to the buyer.

Key Responsibilities

Seller's Obligations:
Clear the goods for export.
Transport the goods to the named port of shipment.
Load the goods onto the shipping vessel.
Once loaded, the seller’s responsibility for the goods ends.

Buyer's Obligations:

Assume all risk of loss or damage once the goods are on board.
Pay all costs for main carriage (freight), insurance, and further transport.
Handle import customs clearance, duties, and taxes at the destination.

Important Considerations

Transport Mode: While "FOB" is officially restricted to sea and inland waterway transport under standard Incoterms rules, the term "FOB Origin" is sometimes used more broadly in domestic commerce (such as in the U.S.) to describe transfer of risk at the point of shipment regardless of the transport mode.

FOB Destination vs. Origin: The primary difference lies in the transfer point. In FOB Destination, the seller retains risk and cost responsibility until the goods reach the buyer's specified location.

Ex Works (EXW) : is an Incoterm where the seller’s only responsibility is to make goods available at a designated location, such as their factory or warehouse. The buyer assumes all costs, risks, and responsibilities for loading, transport, customs clearance, and insurance from that point onward.

Key Responsibilities under EXW:

Seller's Obligations: Minimal. They must package the goods, label them appropriately, and notify the buyer when they are ready for collection at the agreed-upon location. They are not responsible for loading the goods onto the transport vehicle.

Buyer's Obligations: Maximum. The buyer must:
Load the goods onto the transport vehicle.
Handle all export and import customs formalities.
Arrange and pay for all transportation, insurance, and handling costs from the seller's premises to the final destination.

Important Considerations

Risk Transfer: Risk transfers from the seller to the buyer the moment the goods are made available at the specified location.

Logistics Expertise: Because the buyer is responsible for the entire export process—including potentially complex customs declarations in the seller's country—EXW is often considered unsuitable for buyers who lack local logistics experience or established contacts in the seller's region.
Usage: It applies to all modes of transport.

Under FOB (Free On Board) Incoterms, the buyer is responsible for all costs and risks associated with importing the goods, including customs clearance, duties, and taxes at the destination. While the seller (CLVCARGO) clears the goods for export at the origin port (United kingdom), the buyer takes over once the goods are loaded in the Ship.

Key responsibilities for the buyer under FOB include:

Import Customs Clearance: Filing necessary documentation with customs authorities in the destination country.

Duties and Taxes: Paying all import duties, VAT, and fees upon arrival.

Transport & Handling: Arranging and paying for freight from the port of loading to the final destination.

Risk Mitigation: Assuming responsibility for loss or damage during main carriage.

The seller's duty ends once the goods are safely loaded onto the vessel at the agreed-upon port of origin.

Yes, a business can, and often must, deal with a customer who has made a false claim of being scammed (friendly fraud) by implementing stricter, well-documented procedures to protect against financial loss.
Options include blacklisting the user, disputing chargebacks with evidence, and requiring stronger confirmation for future orders.

Steps to Manage False Scam Claims:

Evidence Collection: Maintain robust, indisputable evidence, including delivery tracking, IP logs, and customer signatures.

Dispute the Chargeback: Actively fight fraudulent chargebacks through the payment processor within the allowed timeframes.

Account Termination/Blacklisting: Block the user's account to prevent further "friendly fraud".

Enhanced Verification: For high-risk or suspicious customers, require stronger, direct confirmation for orders before shipping.

Report the Fraud: For serious, repeat offenders, report the fraudulent activity to the police to create a record of the crime.
Friendly fraud, where a customer claims a false scam, is increasing and can lead to significant financial loss and higher merchant fees.
