Safety Reminder: Seat Belts Aren’t Optional

A recent HSE prosecution highlights the potentially devastating consequences of getting workplace transport safety wrong.

A 27-year-old dumper truck driver suffered crushing injuries to his leg, including a broken foot and ankle, after a one-tonne dumper overturned when reversing into an unprotected excavation.

The HSE investigation found that:

🔴 The driver was not wearing his seat belt
🔴 Workers had reportedly been instructed not to wear seat belts when operating the dumpers
🔴 Operators routinely fastened the belt behind them to disable the warning system
🔴 Open excavations were not adequately protected to prevent vehicles entering them
🔴 The dumper manufacturer's instructions required the seat belt to be worn

The company was fined £20,000, with a further £4,824 in costs.

🚨 The important lesson?

Seat belts on workplace vehicles aren't there to annoy drivers or silence a warning buzzer. They are a critical safety feature, designed to keep the operator within the protective zone of the vehicle's rollover protection structure if the vehicle overturns.

DVLA update: More medical conditions can now be notified online 🚗🏍️

Good news for car and motorcycle licence holders, the DVLA has expanded its online service, meaning motorists can now notify them of a wider range of medical conditions online.

The online service makes the process simpler by reducing the need for paper forms and can help applications to be processed more efficiently.

Drivers can also:
✅ Renew a medical licence and driving licence photo at the same time
✅ Track the progress of their application
✅ Save up to 10 days compared with making a paper application

🔎 Does a medical condition affect your driving? If you're unsure, you can check the DVLA guidance and notify them online where required.

For employers and fleet operators, it's another useful reminder that driver licence and medical fitness checks are an important part of managing driver risk. 🚛

𝗟𝗼𝗼𝘀𝗲 𝗪𝗵𝗲𝗲𝗹 𝗡𝘂𝘁𝘀 𝗖𝗮𝗻 𝗖𝗼𝘀𝘁 𝗟𝗶𝘃𝗲𝘀 𝗮𝗻𝗱 𝗬𝗼𝘂𝗿 𝗢𝗽𝗲𝗿𝗮𝘁𝗼𝗿'𝘀 𝗟𝗶𝗰𝗲𝗻𝗰𝗲 🔩

A recent Public Inquiry has highlighted just how critical daily vehicle checks are after a haulage operator had its 𝗢𝗽𝗲𝗿𝗮𝘁𝗼𝗿'𝘀 𝗟𝗶𝗰𝗲𝗻𝗰𝗲 𝗿𝗲𝘃𝗼𝗸𝗲𝗱.

During a DVSA inspection, a tractor unit was found to have been operating for 𝗼𝘃𝗲𝗿 𝗮 𝗺𝗼𝗻𝘁𝗵 𝘄𝗶𝘁𝗵 𝗮𝗻 𝗲𝗻𝗴𝗶𝗻𝗲 𝘄𝗮𝗿𝗻𝗶𝗻𝗴 𝗹𝗶𝗴𝗵𝘁 𝗶𝗹𝗹𝘂𝗺𝗶𝗻𝗮𝘁𝗲𝗱, while a trailer was discovered with 𝗮𝗹𝗹 𝟭𝟬 𝘄𝗵𝗲𝗲𝗹 𝗻𝘂𝘁𝘀 𝗹𝗼𝗼𝘀𝗲 𝗼𝗻 𝗼𝗻𝗲 𝘄𝗵𝗲𝗲𝗹.

The Deputy Traffic Commissioner described the condition as placing pedestrians and other road users at 𝘀𝗲𝗿𝗶𝗼𝘂𝘀 𝗿𝗶𝘀𝗸, warning that the consequences of a wheel becoming detached "do not bear thinking about."

This case is a stark reminder that 𝘄𝗵𝗲𝗲𝗹 𝘀𝗲𝗰𝘂𝗿𝗶𝘁𝘆 𝗶𝘀 𝗻𝗼𝘁 𝘀𝗼𝗺𝗲𝘁𝗵𝗶𝗻𝗴 𝘁𝗼 𝘁𝗮𝗸𝗲 𝗳𝗼𝗿 𝗴𝗿𝗮𝗻𝘁𝗲𝗱.

Every driver should:
🔩 Check wheel nuts for signs of movement or looseness during every walkaround inspection.
👀 Look for missing wheel nut indicators, rust streaks, shiny metal, elongated stud holes or any signs that a wheel may be working loose.
📝 Report defects immediately, never assume someone else will.
🚛 Never drive a vehicle with known safety defects.

Operators should also ensure:
✅ Drivers are properly trained in carrying out effective daily walkaround checks.
✅ Driver defect reports are completed, reviewed and acted upon.
✅ Maintenance providers investigate and rectify wheel security issues promptly.
✅ Wheel retorquing procedures are followed after wheel removal or replacement.

Fifteen minutes spent carrying out a thorough walkaround inspection could prevent a catastrophic incident, protect lives, and safeguard your Operator's Licence.

❌ 𝗠𝗬𝗧𝗛: "A clean driving licence means they're a safe driver."

✅ 𝗙𝗔𝗖𝗧: A clean driving licence doesn't always tell the full story.

A driver may have no penalty points, but could still have poor driving habits, skip vehicle checks, ignore defects, or fail to follow drivers' hours and tachograph rules. Equally, a driver with historic points may have learned from their mistakes and now demonstrate excellent driving standards.

Safe driving is about far more than what's printed on a licence. It includes:

✔️ Carrying out thorough daily walkaround checks.
✔️ Following drivers' hours and tachograph rules.
✔️ Reporting defects promptly.
✔️ Driving responsibly and professionally.
✔️ Taking part in regular training and assessments.

For operators, checking driving licences is only one part of managing driver risk. Ongoing monitoring, training and a strong safety culture are what really help keep drivers, vehicles and other road users safe.

💡 𝗥𝗲𝗺𝗲𝗺𝗯𝗲𝗿: A clean licence is a good start but it's not proof of a safe, compliant driver.

𝗢𝗽𝗲𝗿𝗮𝘁𝗶𝗻𝗴 𝗪𝗶𝘁𝗵𝗼𝘂𝘁 𝗮𝗻 𝗢𝗽𝗲𝗿𝗮𝘁𝗼𝗿'𝘀 𝗟𝗶𝗰𝗲𝗻𝗰𝗲 𝗜𝘀 𝗡𝗼𝘁 𝗪𝗼𝗿𝘁𝗵 𝘁𝗵𝗲 𝗥𝗶𝘀𝗸 🚛

A recent prosecution has highlighted the serious consequences of operating commercial vehicles without the correct licences and compliance systems in place.

Following a roadside stop by the DVSA, an HGV recovery operator was found to be operating a five-tonne recovery vehicle without an Operator's Licence. Further investigations uncovered multiple offences, including:

❌ Operating without an Operator's Licence.
❌ Failing to use a tachograph.
❌ Failing to produce tachograph records.
❌ Operating with an uncalibrated tachograph.
❌ Driving without a valid Driver CPC qualification.

The court described the scale of the offending as "extremely serious" and referred to it as a "spectacular failure" to comply with the law.

The driver received:
⚖️ An eight-month prison sentence, suspended for 12 months.
⚖️ Nearly £3,200 in costs and surcharges.
⚖️ A criminal conviction for multiple transport offences.

An Operator's Licence is not simply a piece of paper—it is a legal requirement that demonstrates an operator has the systems, financial standing, maintenance arrangements, and management controls necessary to operate commercial vehicles safely and compliantly.

Operators must ensure they:
✅ Hold the correct Operator's Licence before operating in scope vehicles.
✅ Have effective maintenance and inspection arrangements in place.
✅ Use and download tachographs correctly.
✅ Ensure drivers hold valid Driver CPC qualifications.
✅ Keep accurate records and comply with drivers' hours legislation.
✅ Understand and meet all Operator Licence undertakings.

The Traffic Commissioners and DVSA expect operators to know and follow the rules. Failing to do so can lead to prosecution, financial penalties, loss of repute, and even imprisonment.

Compliance isn't optional, it's fundamental to keeping our roads safe and protecting your business.

🚛 Monday Myth Buster 🚛

❌𝗠𝗬𝗧𝗛: "Hands-free mobile phones – if it's legal, it's safe."

✅ 𝗙𝗔𝗖𝗧: While using a hands-free mobile phone is not automatically illegal, it can still be dangerous and could land you in trouble.

Research has consistently shown that it's the conversation itself, not just holding the phone, that distracts drivers. Being mentally distracted can reduce your awareness, slow your reaction times and increase the risk of missing hazards.

If the police believe you're not in proper control of your vehicle because you're distracted by a hands-free call, you could still be prosecuted for careless or dangerous driving.

As a professional driver, your attention should always be on the road. If a call is likely to distract you, the safest option is to find a safe place to stop before answering or making that call.

💡 Remember: Just because something is legal doesn't mean it's the safest choice.
