🚛 ⛴️ Ferry crossings: rest or availability time?

Under Regulation (EC) No 561/2006, drivers in Europe may take their rest periods on ferries, provided they have access to a suitable berth or cabin.

However, in Spain the interpretation is changing.

A recent ruling by the High Court of Justice of the Balearic Islands, following the doctrine of the Spanish Supreme Court (2024), establishes that:

Time spent on a ferry is considered availability time, not rest.

Why?

During the crossing, the driver:

🔹 does not have free disposal of their time

🔹 must remain available at all times



What are the implications for transport companies?

🔹 Obligation to take rest after disembarkation

🔹 Increased complexity in national and international routes

🔹 Higher labour and operational costs

🔹 Risk of penalties due to incorrect planning

Although European regulations allow it, Spain applies a more restrictive criterion, considering that the driver does not have free disposal of their time during the crossing.

The debate remains open and will return to the Supreme Court to unify doctrine.

It is with great sadness that we share the news that our friend and colleague Michael Ormonde has passed away. Michael worked as a sub-contractor for us for over 25 years. He was a hard worker and very reliable. He was a larger than life character and will be sadly missed. Keeping Michael's family in our thoughts. May he rest in peace. Funeral arrangements below.
