U.S. tariff pressure on Indian exports continues under a new and more permanent framework.

The proposed forced-labour tariff on India has been reduced from 12.5% to 10%, following India’s decision to ban imports made using forced labour. However, this should not be viewed as tariff relief.

The temporary 10% Section 122 tariff has now been replaced by a permanent 10% Section 301 duty. As a result, nearly 60–70% of Indian exports to the U.S. will continue to attract the normal U.S. MFN tariff along with an additional 10% duty.

The impact continues across engineering goods, textiles and garments, chemicals, machinery, plastics, leather, furniture, and gems and jewellery.

Existing Section 232 tariffs of 25–50% on steel, aluminium, copper and auto parts remain unchanged. India has also not been included in the textile Tariff-Rate Quota exemption granted to Bangladesh, Cambodia, Indonesia and Malaysia for specified exports using U.S. origin cotton and fibre.

For Indian exporters, the legal framework has changed, but the overall tariff burden remains. Businesses must reassess landed costs and pricing, protect margins through efficiency and value addition, and closely monitor further U.S. trade policy developments that could introduce additional duties.

The key takeaway: U.S. tariffs are no longer a temporary disruption they are becoming a lasting feature of global trade.
