New increase of Mexican import duties\

On April 22, 2024, the Ministry of Economy published in the Federal Official Gazette (DOF for its zacronym in Spanish) a Decree that reforms the Mexican Tariff Schedule, which entered into effect the day after its publication and will be effective during two years after the date of its publication.

It is important to note that the Decree mentioned in the preceding paragraph abrogates the Decree published on August 15, 2023.

In this new Decree, on one hand, import duty rates are maintained for certain goods in accordance with the Decree of August 15, 2023, and, on the other hand, duties are imposed on various HTS (in some cases up to 50%) affecting multiple sectors, including steel, aluminum, footwear, textiles, plastics and their manufactures, chemical products, paper and cardboard, glass, electrical and transportation materials.

Additionally, aiming to protect the electric, automotive and auto parts industries, the Decree includes HTS in the Sectorial Promotion Program (known in Spanish as PROSEC), so they can
be imported exempt of such duties.

Please bear in mind that the afore mentioned duties can be exempted, provided the imported goods are originating from any of the Free Trade Agreements signed by our country (USMCA,
CPTPP, etc.) and the importers have the corresponding Certificate of Origin.

Borderlands Mexico: U.S. agricultural imports from Mexico at $8B in 2024

Exports of Mexican beer over $1B in first 2 months of year

Mexico recorded $9.06 billion in agricultural exports during the first two months of the year, according to the country’s Ministry of Agriculture and Rural Development (SADER) and the Bank of Mexico.

The total represents a 9% year-over-year increase from the same period in 2023. The U.S. accounts for almost 90% of Mexico’s export marketplace, importing about $8.1 billion during the first two months of 2024, followed by Canada and China.

Top agricultural and beverage exports from Mexico in January and February included beer ($1.06 billion), tomatoes ($630 million) tequila ($621 million), avocados ($594 million), strawberries and raspberries ($531 million), and peppers ($427 million).

Mexican exports that saw the largest increases overall during the first two months of 2024 included chocolate (72%), coffee and tea (64%), frozen orange juice (62%), guava, mango and mangosteens (49%), grapes (38%), and cattle (36%).

As of November 2023, Mexico has 13 Free Trade Agreements (FTAs) with 50 countries, including the United States, the European Union, Japan, Israel, and 10 Latin American countries. The main goals of these agreements are to: Remove trade barriers, Promote fair competition, Increase investment opportunities, and Protect intellectual property rights.

On April 22, Mexico increased import duties to 544 tariff lines ranging between 5% and 50%. The increase will be enforced for two years, ending in April 2026.

Among the products covered by the new measure are the following: steel, aluminum, textiles, clothing, footwear, wood, plastics, chemical products, paper and cardboard, ceramic products, glass, electrical equipment, transport equipment, musical instruments, and furniture. Agricultural products are not included.

Import duties will not apply to originated goods from countries with which Mexico has signed a Free Trade Agreement (e.g., USMCA, CPTPP). (See chart below) Thus, the impact will be particularly significant for imports from non-FTA countries, such as China, Brazil, or Indonesia.

The import duties will not affect industrial production mechanisms such as maquiladoras or specific sectorial programs (e.g., auto parts or automotive) intended to promote the production of goods for export.

¿Qué es el Número de Identificación Comercial (NICO)? 🔎​📦​🌎​

Los llamados códigos arancelarios son un sistema de clasificación a través del cual se identifica un producto y se organiza en una categoría a nivel internacional.

Además de facilitar el intercambio de mercancías, también tiene la intención de facilitar el procesamiento de productos en el sistema de aduanas y el despacho aduanero, así como la recaudación de aranceles.
