๐ TERMS AND CONDITIONS OF CARRIAGE

โ๏ธ 1. INTERPRETATION
โCompanyโ refers to Smart Cargo Malaysia Sdn. Bhd.
โSenderโ refers to the party tendering the shipment.
โReceiverโ refers to the consignee.
โShipmentโ refers to any parcel, goods, or documents accepted under a single consignment.
๐ 2. APPLICATION OF TERMS
These Terms and Conditions apply to all services provided by the Company.
By handing over a shipment, the Sender confirms full acceptance of these Terms.
๐ 3. RIGHT OF INSPECTION
The Company reserves the right to open and inspect any shipment without prior notice to ensure compliance with applicable laws and regulations.
๐ 4. SERVICE SCOPE
The Company arranges transportation through its network or partners.
All services are subject to operational availability, regulations, and destination access.
๐ซ 5. PROHIBITED & RESTRICTED ITEMS
Shipments containing illegal, hazardous, or restricted items are strictly prohibited.
The Company reserves the right to refuse, return, or dispose of such shipments at the Senderโs risk and expense.
๐งพ 6. SENDERโS RESPONSIBILITIES
The Sender is responsible for:
โข Providing accurate shipment information
โข Ensuring proper packaging
โข Complying with customs regulations
โข Paying all applicable charges, taxes, and duties
๐ 7. CUSTOMS & REGULATORY COMPLIANCE
International shipments may be subject to customs clearance.
Delays caused by customs or incomplete documentation are beyond the Companyโs control.
โณ 8. TRANSIT TIME DISCLAIMER
All delivery timeframes are estimates only and are not guaranteed unless stated in writing.
The Company is not liable for delays caused by external factors.
๐ณ 9. CHARGES & PAYMENT
All charges must be paid by the Sender unless otherwise agreed.
Additional charges may apply for storage, re-delivery, or customs-related costs.
๐ฐ 10. LIABILITY & COMPENSATION
Liability for loss or damage is limited and subject to Company policy.
Standard compensation:
๐ RM 20.00 per kilogram OR
๐ Maximum liability cap (if applicable)
The Company shall not be liable for indirect or consequential losses.
๐ฆ 11. DELIVERY & UNDELIVERED SHIPMENTS
Delivery is considered complete upon handover or availability for collection.
If undelivered, the Company may:
โข Attempt re-delivery
โข Return shipment
โข Store or dispose of goods (charges may apply)
๐ 12. CLAIMS PROCEDURE
Claims must be submitted within required timeframes with supporting documents.
Failure to comply may result in rejection.
โ ๏ธ 13. FORCE MAJEURE
The Company is not liable for delays or failures caused by events beyond its control, including natural disasters, government actions, or disruptions.
๐ 14. DATA & INFORMATION
Shipment data may be used for operational, security, and compliance purposes in accordance with applicable laws.
โ๏ธ 15. GOVERNING LAW
These Terms shall be governed by the laws of the shipment origin country unless otherwise required.
๐ 16. GENERAL PROVISIONS
If any clause is invalid, remaining provisions remain enforceable.
These Terms constitute the full agreement between all parties.
๐ 17. POLICY AMENDMENTS
The Company reserves the right to modify these Terms at any time without prior notice.
