IEEPA Tariff Refunds

Dear Trade Community,

As for the latest news associated to IEEPA Tariffs, there will be a “bulk” process where all Customs entry numbers will be downloaded by a Broker or Self-Filer into a CBP ACE Portal feature to expedite the refund process.

The intention is to have a process in place that is easier than Post-Summary Corrections.

ACE ACH Refunds

Refunds will occur through ACE ACH electronically.

Only 9% (21,000) of U.S. Importers of Record (IOR) filers of the over 300,000 IOR filers with IEEPA tariffs have correctly completed the ACE ACH Portal enrollment process.

Please follow these steps to authorize refunds:

Log into the ACE Portal (Trade/PGA User Login)
Navigate to the “Importer” Sub-Account.
Select "ACH Refund Authorization" tab.
If needed, authorize a Trade Account User to manage this tab.
Enter your U.S. bank Routing and Account Numbers to enable electronic, direct-deposit refunds.

Clients are encouraged to monitor liquidations by running ACE Portal Reports.

FTZ Process-IEEPA Tariffs

Dear Trade Community,

ACE updates for FTZ Type 06 Cargo Release and Entry Summary programming are complete and at this time CBP Headquarters has no intention of providing written guidance.

FTZ Type 06 Cargo Releases with Privileged Foreign (PF) election dates prior to February 24, 2026, but filed on or after February 24, 2026, will not have IEEPA tariffs assessed.

Merchandise with PF election dates prior to February 24, 2026 will not be subject to Section 122 tariffs on Cargo Releases filed on or after February 24, 2026.

Merchandise with PF election dates after February 24, 2026 will be subject to Section 122 tariffs upon Customs entry filing.

Up-Date to the Supreme Court IEEPA Tariff Decision

Dear Trade Community,

US Customs and Border Protection has issued its guidance for the ending of collections of International Emergency Economic Power Act Duties as of 12:00am on February 24, 2026.

Following the Executive Order (EO) "Ending Certain Tariff Actions",

Duties imposed pursuant to IEEPA under the following presidential actions, including all modifications and amendments, will no longer be in effect and will no longer be collected for goods entered for consumption or withdrawn from warehouse for consumption, on or after 12:00 a.m. eastern time on February 24, 2026:

* Executive Order 14193, Imposing Duties To Address the Flow of Illicit Drugs Across Our Northern Border, 90 Fed. Reg. 9113 (Feb. 1, 2025), as amended;
* Executive Order 14194, Imposing Duties To Address the Situation at Our Southern Border, 90 Fed. Reg. 9117 (Feb. 1, 2025), as amended;
* Executive Order 14195, Imposing Duties To Address the Synthetic Opioid Supply Chain in the People's Republic of China, 90 Fed. Reg. 9121 (Feb. 1, 2025), as amended;
* Executive Order 14245, Imposing Tariffs on Countries Importing Venezuelan Oil; 90 Fed. Reg. 13829 (Mar. 24, 2025);
* Executive Order 14257, Regulating Imports With a Reciprocal Tariff To Rectify Trade Practices That Contribute to Large and Persistent Annual United States Goods Trade Deficits, 90 Fed. Reg. 15041 (Apr. 2, 2025), as amended;
* Executive Order 14323, Addressing Threats to the United States by the Government of Brazil, 90 Fed. Reg. 37739 (July 30, 2025); and
* Executive Order 14329, Addressing Threats to the United States by the Government of the Russian Federation, 90 Fed. Reg. 38701 (Aug. 6, 2025), as amended.

This EO affects IEEPA duties only and does not affect any other duties, including duties imposed under section 232 of the Trade Expansion Act of 1962, as amended, and section 301 of the Trade Act of 1974, as amended.

This EO is not retroactive.

Thus, for shipments due to be processed today, our team of Entry Writers and Traffic Specialists has been instructed to wait for the EO to be in effect.

Se discutieron temas esenciales como el Harmonized Tariff Schedule (HTS), los cambios arancelarios por país de origen, el momento de implementación y la importancia de los Incoterms en la correcta distribución de costos y responsabilidades.

La actividad reafirma la importancia de contar con el conocimiento de especialistas licenciados en Aduanas para apoyar la toma de decisiones logísticas y la planificación estratégica de importaciones y exportaciones.
