NEW IDAHO BOATING ENFORCEMENT RULE NOW IN EFFECT

A major change is now in effect for boaters on Idaho waters.

Under House Bill 548, which took effect July 1, 2026, Idaho county sheriffs and deputy sheriffs must now have reasonable suspicion that a violation has occurred before they may stop and board a vessel under the Idaho Safe Boating Act.

That is a significant change from the previous Idaho boating enforcement language. Before this change, the law allowed sheriffs and deputies to stop and board vessels while enforcing boating laws, including safety and equipment requirements. During those contacts, officers could also investigate things like boating under the influence, drug violations, equipment violations, registration issues, or other offenses observed during the stop.

Now, boating stops by county sheriffs and deputies are much closer to what people are used to on the roadway. There needs to be a specific reason for the stop, not just a random safety inspection.

That reason could include things like unsafe operation, suspected impairment, speed or wake violations, visible registration issues, towing violations, or other boating law concerns.

This does not mean boating rules are going away. Boaters are still required to follow Idaho law, carry required safety equipment, operate safely, and stay sober while operating a vessel.

A separate recent Idaho boating law also changed some rules for water skiing, tubing, wakeboarding, wakesurfing, and similar towing activities.

Idaho law still generally requires a competent observer in the boat when towing someone. However, there is now an exception when the vessel has a large mirror firmly mounted so the operator can face forward and observe the person being towed at all times.

That mirror exception applies in certain situations, including legal permitted slalom courses, early morning operation from one hour before sunrise until 9:00 a.m. between May 15 and September 10, and at any time of day from September 11 through May 14.

A warning flag is still required when towing. The flag must be international orange or red, at least one foot square, and displayed when the person being towed is down in the water.

Important note: this does not change Idaho’s mandatory watercraft inspection station requirements or federal Coast Guard authority.

Bottom line: Idaho boaters now have more protection from random county boating stops, but they are still responsible for knowing and following boating safety laws.
