BREAKING - Supreme Court Invalidates IEEPA Tariffs

The U.S. Supreme Court has just issued a decision invalidating the IEEPA tariffs. The decision is silent on the issue of refunds, however there is no express prohibition to obtain them.

The Court says nothing today about whether, and if so how, the Government should go about returning the billions of dollars that it has collected from importers. But that process is likely to be a โ€œmess,โ€ as was acknowledged at oral argument.

U.S. Increases Tariffs on Imports from China, Canada, Mexico.

All imports of articles that are products of Canada, other than products classifiable under headings 9903.01.11, 9903.01.12, and 9903.01.13, (ie. donations, relief goods, informational materials, energy) and other than products for personal use included in accompanied baggage of persons arriving in the United States, will be assessed an additional ad valorem rate of duty of 25%.

All imports of articles that are products of Mexico, other than products classifiable under headings 9903.01.02 and 9903.01.03 (ie. donations, relief goods, informational materials) and other than products for personal use included in accompanied baggage of persons arriving in the United States will be assessed an additional ad valorem rate of duty of 25%.

All imports of articles that are products of China and Hong Kong, other than products classifiable under headings 9903.01.21, 9903.01.22, and 9903.01.23, (ie. donations, relief goods, informational materials, personal baggage) and other than products for personal use included in accompanied baggage of persons arriving in the United States, will be assessed an additional ad valorem rate of duty of 20%.

CBP is expected to continue its normal operations at U.S. ports with staffing at levels to permit continued flow of trade. CBP is expected to continue cargo processing and inspections at the U.S. ports of entry; security screenings and revenue collection; and enforcement activities related to alleged antidumping duty and countervailing duty evasion pursuant to the Enforce and Protect Act. However, policy, regulatory, legislative, auditing, and training activities will likely be suspended in line with past practices.

As September 30 approaches, importers should also be cognizant of the operational impacts of a potential government shutdown on other Partner Government Agencies (PGAs) involved with processing imported merchandise, including the U.S. Environmental Protection Agency, U.S. Food and Drug Administration, and U.S. Department of Agriculture, which may result in slower clearance of shipments subject to review.

As members of Congress continue to negotiate government spending levels allotted for the next fiscal year, the United States is poised for its fourth partial government shutdown in the last decadeโ€”putting at risk the regular operations of U.S. agencies responsible for trade activities.
