DOES YOUR EMPLOYER NEED YOUR PERMISSION TO CHECK YOUR CLEARINGHOUSE AGAIN?
If a trucking company wants to check your FMCSA Clearinghouse record again, they generally need your consent for that query.
For example, you give an employer permission to check your record when you're applying for a job. If they need to run another query later, you may need to provide consent again.
Here's what CDL drivers should know:
β
Employers must obtain the required consent before conducting a query.
β
A query lets an employer check whether there is information in your Clearinghouse record that could affect your eligibility to perform safety-sensitive duties.
β
Employers are required to conduct certain Clearinghouse queries as part of their compliance responsibilities.
β
If information in your record changes, the employer may receive notification that they need to review the updated information.
Don't assume your employer is continuously looking at your record. Understanding when and why a Clearinghouse query happens can help you know what to expect.
