For the record....

There are Bi-State member companies that only work with employee company drivers. There are others who work with a combination of company drivers and owner operators. The Bi-State doesn't take sides in the argument over which is "better" and we do not push for one model over another--despite the misinformation you may see from people who keep trying to force their own extremist political views and controlling ideology on their fellow drivers.

Instead, we have been helping owner-operator drivers across New Jersey secure personal meetings with the legislators that represent them--including the Governor--so that the voices of real owner operators can be heard without interference from anyone. These drivers have been meeting face-to-face with their lawmakers, expressing their concerns over how the ABC rules impact their ability to continue working in New Jersey. We're not speaking for them. What we ARE doing is making sure real drivers have a seat at the table.

That's the truth; whether you choose to believe it or not is up to you.

Pushing back on the new ABC rules isn't about trying to force someone to be an employee or an independent contractor, it's about protecting the fundamental ability for individuals to choose for themselves. Freedom, not control.

In today's Substack post, Independent Contractor Advocate Kim Kavin provides an informative overview of last week's Senate hearing where Acting NJDOL Commissioner Jarvis was questioned about the ongoing confusion surrounding the state's new regulations governing the ABC classification test. Senators from both parties said they have been flooded with calls from constituents in numerous professions who remain uncertain on how to comply. When asked for specifics on how to determine compliance, Jarvis said, "read the regulations."

Throwback Thursday: Kim Kavin's 2025 Congressional testimony is even more relevant today for New Jersey's Independent Contractors and the businesses that risk working with them. The new DOL rule for determining employee status has caused mass confusion and uncertainty, and it's now up to state lawmakers to take action to stop the relentless weaponization of our labor regulations. Governor Sherrill appeared on News12NJ's "Ask The Governor" and made the same claim about how nothing is changing for Independent Contractors tomorrow when the new NJDOL rule takes effect. She then says that *if* anyone is impacted she will work with the legislature on carveouts. CALL TO ACTION FOR INDEPENDENT CONTRACTORS

We continue to hear that despite growing calls from legislative leaders and industries across the state, Governor Sherrill & the NJDOL are planning to proceed with the Oct 1 effective date for the new regulations that make it impossible to know for sure if an owner-operator trucker will be reclassified as an employee, because they refuse to reveal all of the factors used to make that determination.

We are being told that THEY NEED TO HEAR FROM YOU: business owners, drivers, customers, and anyone else who may be impacted by this rule.

I am urging everyone to specifically call the following people TODAY—we need to flood their phone lines the way we did in 2019:

Governor Mikie Sherrill – (609) 292-6000
Tell her how this will hurt your ability to do business in New Jersey, and urge her to issue an Executive Order delaying the rule.

Senator Scutari has been a strong ally, publicly urging the Governor to delay the rule. Thank him for his efforts and ask him to use his powers as the Senate President to overturn the rule through the legislature with the immediate passage of SCR-138 and ACR-177.

Assemblyman Craig Coughlin – (732) 855-7441, [email protected]
The Assembly Speaker has been disappointingly silent on this issue, failing to join Senator Scutari in his efforts to delay the rule. Urge Assemblyman Coughlin to step up and support the port trucking community he represents (his district includes Carteret, Perth Amboy, Sayreville, South Amboy, and Woodbridge) and move to pass ACR-177 through the Assembly as an emergency.

A large number of Safety Induction credentials are expiring on October 7th. These credentials MUST be kept current for drivers to access the terminal.
