Incoterms decide who pays for what, and who's on the hook when something goes wrong. Get them wrong, and it's your bottom line that absorbs the mistake. Here are 3 mistakes we see importers make constantly:

1. Defaulting to FOB because it's familiar. FOB puts you in control of the main freight, insurance, and risk the moment the goods clear the origin port. If you're not set up to manage that, you're exposed the second the container is loaded.

2. Assuming DDP means "done and worry-free." DDP shifts nearly ALL responsibility (duties, taxes, customs clearance) onto the seller. Sounds great, until a customs issue holds your shipment and you have zero visibility into why, because you weren't the one managing the process.

3. Not matching the Incoterm to your actual capabilities. Choosing EXW because it looks cost-effective on paper, then realizing you don't have the freight, customs, or trucking relationships to execute it, is one of the most expensive mistakes importers make.

If your cargo is damaged in transit, how much do you think the carrier actually owes you?

Most shippers assume carriers are responsible for the full value of a damaged or lost shipment. In reality, carrier liability is capped by law and only applies when direct fault can be proven, which is difficult on multi carrier moves. Under the Carriage of Goods by Sea Act, that liability can be capped at just $500 per package, regardless of what your cargo is actually worth.

A few things every shipper should know:

- A $200,000 shipment damaged in transit could legally be compensated at just $500 if carrier liability applies and no cargo insurance is taken out
- Underinsuring your cargo triggers a co-insurance penalty. Insure a $110,000 shipment for only $55,000, and a covered $55,000 loss could pay out as little as $27,500
- Acts of God, like typhoons or earthquakes, carry zero carrier liability at all
- Cargo insurance can cover your goods for 100% of invoice value plus freight, with no cap on insured value through LogiWorld
