Gov. Pritzker Issues Executive Order for Dyed Diesel
Yesterday, Illinois Governor J.B. Pritzker issued an executive order allowing Illinois farmers and haulers transporting agricultural products to use off-road dyed diesel for on-road purposes and defer payment of applicable motor fuel taxes until December 31, 2026.
The Governor’s declaration is specific to agricultural products and farming operations and does not appear to allow common carriers to use off-road (dyed) diesel in on-road truck operations.
MTA is recommending that carriers NOT use dyed diesel in on-road trucks.
While the declarations from President Trump and Governor Pritzker provide temporary relief by delaying the payment of certain federal and state motor fuel taxes through the end of the year, users will still be responsible for paying the applicable taxes on dyed diesel used for on-road purposes during the grace period.
After the grace period, questions remain regarding compliance and the practical application of proving that dyed diesel was used for a qualified purpose. Carriers should therefore exercise caution before using dyed diesel in on-road operations. Governor Pritzker issued Executive Order 2026-08 without clear guidance from the Illinois Department of Revenue (IDOR) regarding how users are expected to report and pay the applicable motor fuel and use taxes without penalty.
In addition to the dyed-diesel tax relief, the Governor directed the Illinois Department of Transportation (IDOT) to extend the Illinois Harvest Permit (IHP) program through the summer of 2027. This extension allows haulers of agricultural commodities to apply for the free IHP, which permits the transportation of agricultural products at heavier truck weights on designated routes beyond the normal September 1 through December 31 harvest-season period.
